Whiplash is a very common injury in road traffic accidents. It is caused by a sudden acceleration and deceleration, which flexes the tissue in the neck, shoulders and back. Whiplash can sometimes take several days to materialise and it often lasts for many months or years thereafter. Common symptoms are neck, back and shoulder pain, dizziness and loss of feeling or pins and needles in the arms or hands.

With the rise in road traffic levels, road traffic accidents are becoming very common. You may have been involved in a road traffic accident in the following situations:

  • You were the driver of a vehicle (such as a car, van, bus, lorry, motorbike/motorcycle, bike/cycle) involved in a road accident caused by another driver.
  • You were a passenger in a vehicle involved in a road traffic accident caused by either another driver or by the driver of the vehicle you were travelling in, e.g. passenger in a taxi, passenger on a bus or travelling in a friend's car.
  • You were a pedestrian or a cyclist involved in a road traffic accident.

Every case is unique and the compensation awarded is dependant upon your individual case. Examples of compensation amounts awarded for injuries suffered from a car accident:

  • For a minor whiplash type injury - £850 - £5000
  • For a moderate whiplash type injury - £5000 - £16000
  • For a severe neck injury – up to £95000

*Please note that these are guideline figures only.

If you were a passenger in a vehicle and were injured as a result of fault by your driver, you can still make a claim. Some people do not like the idea of making a claim against their friend or family remember but you should know that the claim is directed towards the insurance company of the vehicle and the insurers deal with the claim.

Uninsured or Untraced Drivers – Motor Insurers' Bureau Claims

If you have been the victim (either as a driver, passenger, cyclist or pedestrian) of a 'hit and run' or injured by an uninsured driver, then you may still be able to claim compensation for road traffic accident injury. The Motor Insurers' Bureau (MIB) was established as a central fund to provide a means of compensating the victims of road traffic accidents by negligent uninsured and untraced drivers.

The MIB also deal with claims that involve foreign European Economic Areas vehicles. So if you are involved in an accident with a vehicle from the EEA, whether in the UK or abroad, the MIB may deal with the claim.

If you were injured within the past 3 years and it was not your fault, then you maybe able to make a claim for compensation. One way of funding your accident injury compensation claim is a “No Win, No Fee” agreement, also known as a “Conditional Fee Agreement”. If you win your case, then you should receive 100% of your compensation and your legal costs are also recovered from the other side.  There are a few exceptions but these will be explained to you at the onset of your claim. If you lose your case then you do not have to pay our costs.  However, you maybe responsible for any expenses incurred during your claim (e.g. the cost of obtaining a medical report etc.) and the other side’s legal costs.  To protect you from these expenses, we may take out some Legal Expenses Insurance (LEI) for you.  The cost of this policy is recovered from the other side if you win your claim.  If you lose your claim, then the policy does not cost you anything but still covers you.
